This Privacy Statement outlines KOHC practices pertaining to
collection, use and disclosure of personal information (including
personal health information) in performance of KOHC services.
What is "personal information" for the purpose of this Privacy Statement?
"Personal information" means information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization.
"Personal health information" means:
How we gather personal information
(a) information concerning physical or mental health;
(b) information concerning any health service provided;
(c) information concerning the donation of any body part or bodily substance,
(d) or information derived from the testing or examination of a body part or bodily substance;
(d) information collected in the course of providing health services; and
(e) information collected incidentally to the provision of health services.
KOHC collects the following personal information about an Examinee:
- Contact information (e.g. name, address, e-mail address, telephone);
- Demographic information (e.g. gender, date of birth, occupation);
- Medical information (e.g. medical history and information generated through medical examinations and additional diagnostic testing) from: (i) Referring Sources; (ii) Examinees; and (iii) third party service providers who conduct diagnostic testing on behalf of KOHC.
- Proof of identity (e.g. signature; photo ID).
How we use personal information
KOHC uses an examinee's personal information only in appropriate connection with performance of the IME services. Specifically, personal information is used:
- To confirm an examinee's identity;
- To conduct evaluations of specific condition(s) related to an examinee's injury or illness and any prior or subsequent condition(s) that might affect such injury or illness;
- To communicate with an examinee in relation to the conduct of an evaluation. KOHC does not use personal information about an Examinee for any other purposes without seeking the Examinee's prior consent.
Sharing of personal information
KOHC may share personal information with third parties engaged to assist it in carrying out the IME services. For example, a limited amount of personal information (name, contact information and language preferences) will be shared with a translator assisting in examination of a non-English speaking examinee. Personal information (including personal health information) is shared with medical services providers engaged by KOHC to perform medical, ergonomic and mental health evaluations. These providers are prohibited from using personal information for any purpose other than in provision of this assistance, and are required to protect personal information disclosed by KOHC in accordance with the privacy principles described in this Privacy Statement and in accordance with applicable laws.
Personal information about an examinee, including personal health information obtained through medical examinations and additional diagnostic testing, is shared with the examinee's referring source.
Disclosure of personal information
KOHC does not disclose personal information for purposes unrelated to the IME services. KOHC reserves the right to disclose personal information to a third party if a law, regulation, search warrant, subpoena or court order legally requires or authorizes it to do so.
Knowledge and consent
KOHC collects personal information only with an examinee's consent. An examinee may withdraw their consent at any time, with reasonable notice, and subject to any legal or contractual restrictions. In such case, the examinee may contact KOHC as shown at the foot of this page. The examinee will be informed of the implications of withdrawing consent.
How we protect the examinee's personal information
Access to personal information, whether hard copy or electronically stored, is restricted to KOHC personnel and an examinee's representatives on a strict need-to-know basis. KOHC deploys standard information security techniques, such as firewalls and access control procedures, to guard personal information from loss and unauthorized access.
Retention of Personal Information
Personal information is retained by KOHC for as long as required to fulfill the purposes for which it was gathered and to comply with applicable laws.
Changes to this Privacy Statement
KOHC reserves the right to modify this Privacy Statement at any time, without notice. The Privacy Statement distributed at any time shall be deemed to be the Privacy Statement then in effect.
